Covid-19 IgG/IgM Rapid Tests:

Customer will use and/or further distribute the Products in compliance in all material respects with product labeling and applicable federal and state healthcare industry laws, regulations, and policies, including but not limited to the Federal Food, Drug, and Cosmetic Act, the Clinical Laboratory Improvement Amendments, and the False Claims Act.  Customer understands that this test has not received a CLIA categorization by FDA and is therefore considered high complexity by default.Customer understands that this test should be used only in a CLIA-certified high-complexity laboratory and should not be used to test fingerstick whole blood.

 

The Customer shall indemnify, defend, and hold harmless the Distributor from, against, and with respect to, and will compensate and reimburse Distributor for any and all losses, arising out of or in any manner incident, relating to or attributable to any breach of any representation or warranty by the Distributor.  

 

The representations and warranties contained herein shall remain in full force and effect throughout the period set forth for execution of this distribution arrangement.
